San Jose: The San Jose Police Department is investigating an officer involved shooting that occurred on August 17, 2015.

On Monday, August 17, 2015, at 6:55 p.m., San Jose Police officers assigned to the MERGE Unit were following the suspect, who was considered armed and dangerous, and possibly in possession of a TEC-9 assault weapon, and had an outstanding arrest warrant for murder on the homicide that occurred on 8-13-15 in the City of San Jose (SJPD Case # 15-225-0035).

Officers were following the suspect in a car containing a female passenger. Investigators received credible information that the suspect would be confrontational with officers and planned to kill the female. The suspect realized he was being followed and attempted to evade officers. Officers initiated a vehicle pursuit. The suspect slowed down and jumped out of the moving car while it continued to roll forward and collided with a parked vehicle on Kirkhaven Court. The female stayed in the car and ultimately secured by officers. She was unharmed.

The officer chased after the suspect while giving commands to stop. The suspect continued to run towards a residence at the end of the court where the suspect attempted to gain entry into this unknown residence that was possibly occupied.

The officer yelled at the suspect to stop and gave commands. The suspect did not comply. Based on public safety concerns the officer had, the officer fired at the suspect prior to reaching the front door. The suspect turned around and the officer fired again. The suspect was pronounced deceased at the scene. The officer was placed on routine paid administrative leave.

The SJPD Homicide Unit is conducting the criminal investigation. The case is being monitored by the SJPD Internal Affairs Unit and the Santa Clara County District Attorney's Office.

Anyone with information is asked to contact Detective Sergeant Pat Guire or Detective Ken Tran of the SJPD's Homicide Unit at 408-277-5283.
