San Jose Seeks Public Input on Allowing Medical Marijuana Collectives to Provide Non-Medical Cannabis


San Jose, CA – The San Jose Police Department’s Division of Medical Marijuana Control will be holding a community meeting to discuss whether or not to allow registered medical cannabis collectives to add non-medical (“recreational / adult-use”) cannabis transactions.

With voter approval of Proposition 64, the Adult Use of Marijuana Act, in November 2016, non-medical cannabis became legal for those over age 21 in California. Non-medical cannabis includes “adult use” or “recreational” cannabis.

The State of California will begin issuing licenses for medical and non-medical cannabis operators in January 2018. To obtain a state license, an operator must have local authorization (or a “Registration” in San José).

San José has 16 registered medical marijuana collectives. Registration is not open to new applicants, and only the City Council can re-open the registration process.

At the Oct. 30 meeting, the following questions will be addressed: 
  1. Shall the City allow existing registered medical marijuana collectives to provide non-medical marijuana?
  2. Shall existing registered medical marijuana collectives be allowed to deliver non-medical cannabis to people over the age of 21?
