SJPD Arrests Suspect for Assault with Intent to Commit Rape & Other Felony Crimes

San Jose, Calif. - The San Jose Police Department's Sexual Assault Investigation Unit arrested Tung Vo for Assault with Intent to Commit Rape (felony) - Penal Code 220(a)(1), False Imprisonment (felony) - Penal Code 236, and Kidnapping (felony) - Penal Code 207(a).

On Friday, July 6, 2018 at approximately 1:17 PM, A 16 year-old male victim was walking on the 1800 block of Cunningham Avenue in San Jose when suspect Tung Vo asked him for help.  Initially, the victim believed the suspect to be a female requesting assistance.  The suspect lured the victim near the side sliding door of his Toyota Sienna van.  As the victim was near the opening to the van door, the suspect pushed the victim into the van and sexually assaulted him.  The victim was able to get away from the suspect and report the incident to police. 

San Jose police officers responded to the scene and conducted an investigation.  Follow-up investigation by patrol officers lead to the suspect's residence in San Jose where he was taken into custody without incident.  The suspect's van was impounded as evidence.  Suspect Tung Vo is a registered sex offender with a previous conviction for sexual battery and failing to properly register as a sex offender.  He will be booked into Santa Clara County Jail for the above listed violations.
