San Jose: On Wednesday, May 3, 2017, at approximately 9:01 PM, San Jose Police Communications received a call from the adult son of the victims reporting that a suspect had shot his parents. As officers arrived on scene, they saw an adult male deceased in the front doorway, suffering from at least one gunshot wound.  Officers learned from the adult son that his mother and 13 year old brother, along with the suspect, were still inside the house.  In addition, the adult son believed his mother had been shot.

San Jose Police MERGE officers were called and responded to the scene.  As officers were setting containment and arrest teams, the suspect released the 13 year old boy.  San Jose Police Department Tactical Negotiation Unit (TNU) officers arrived on scene and engaged in a dialogue with the suspect in an attempt to get him to surrender peacefully.  Unfortunately, the suspect refused to surrender. 

The suspect appeared and pointed a handgun at officers on the arrest team.  In fear for the life of fellow officers and victims, at least one round was fired by an officer striking the suspect.  MERGE officers entered the residence and located the adult male and adult female homeowners deceased.  The suspect was also located inside the residence deceased.

Follow up investigation revealed the suspect had been in a dating relationship with the victims’ adult daughter, but the relationship ended last year.  The suspect had a history of domestic violence and an active criminal restraining order.  In addition, the suspect had a history of mental illness.

The officer will be placed on routine paid administrative leave. The Santa Clara County District Attorney’s Office and the San Jose Police Department's Homicide Unit are conducting a joint criminal investigation. The case is being monitored by the San Jose Police Department's Internal Affairs Unit, the City Attorney’s Office, and the Office of the Independent Police Auditor.
