Follow up investigation by detectives lead to the identification of the driver of the vehicle. On Sunday, June 18, 2017, the driver voluntarily walked into the San Jose Police Department and agreed to be interviewed regarding the incident.  Detectives interviewed the driver and released him, pending a review by the Santa Clara County District Attorney's Office. 

San Jose, Calif. - On Saturday, June 17, 2017, at approximately 12:08 AM, two San Jose Police officers were assigned in a two person marked police vehicle. They were patrolling in the 1700 block of Oakland Road when they approached a red Mazda Miata that was parked in a parking lot. The officers were looking for this vehicle because it had evaded them earlier when they attempted to stop it for reckless driving.   

As the officers approached the vehicle, the lone driver placed the vehicle in reverse, then accelerated towards one of the officers. The victim officer fired the service weapon at the suspect in defense of the victim officer's life. The suspect driver fled in the vehicle and was able to escape. The officers were not injured.

The suspect is described as a Hispanic male, early 20's. At this time, it does not appear the suspect was injured in the confrontation and area hospitals were checked for walk in shooting victims - none were found.

The suspect vehicle is described as a red Mazda Miata with a black convertible top and paper license plates.

The officer was placed on routine paid administrative leave. The San Jose Police Department's Homicide Unit is conducting the criminal investigation. The case is being monitored by the San Jose Police Department's Internal Affairs Unit, the City Attorney's Office, and the Office of the Independent Police Auditor.
