San Jose, Calif. — On Tuesday, January 9, 2018, at approximately 5:02 PM, San Jose police officers responded to a suspicious vehicle call at Metcalf Energy Center located at 1 Blanchard Road in San Jose.  An employee called police to report a suspicious male at the front gate in a black Mercedes.  The employee further reported that the male pulled something out of the trunk of the Mercedes.

The male was described as an Asian male in his late 20’s, 5’-6”, 145 lbs., wearing a black jacket, white shirt and black pants.  In addition, the license plate provided by the reporting party was identified as “armed and dangerous” from the Santa Cruz County Sheriff’s Department.  At this point, the male gained access onto the property. San Jose police received an additional call from an employee stating that the male had a backpack, pipe, and possibly an axe on his person.

San Jose police officers arrived on scene and located the black Mercedes unoccupied at the front gate.  Inside the vehicle, officers observed a large sword laying on the driver’s seat.  The officers entered the gate and located the suspect armed with a 6 foot pipe and an axe.  They immediately gave the suspect verbal commands to drop the pipe and axe.  The suspect did not comply and walked away from the officers.

The officers followed the suspect a safe distance, continuing commands to drop his weapons.  The suspect ignored commands and yelled, “Shoot me, Kill Me” several times during the incident.  The suspect turned around and advanced toward the officers still armed with the pole and axe.  During the contact, officers ordered the suspect to surrender and drop his weapons no less than 23 times.

When the suspect was approximately 5 to 6 feet away from one of the officers, one officer shot at the suspect.  The suspect continued toward a second officer with the axe and pole still in his hands and a second officer also shot at the suspect.  The suspect was struck at least once. Officers provided first aid until fire personnel arrived on scene. Fire personnel attended to the suspect and pronounced him deceased at the scene.

A search of the suspect’s person reveled that he had an additional axe, 6 throwing knives and pepper spray.  The officers on scene had their body worn cameras activated.

Air 2 responded and played a critical role guiding responding officers and the fire department to the scene. The Bomb and K9 Units responded for a bomb sweep of the area to ensure scene safety.  No explosive devices were located.

The identity of the suspect will not be released until the Santa Clara County Coroner’s Office has confirmed the suspect’s identity and notified next of kin.

The suspect's criminal history included resisting arrest, narcotic and weapons violations.  In addition, he was admitted for a 72 hour psychiatric evaluation in September 2017. 

The officers were placed on routine paid administrative leave.  The Santa Clara County District Attorney’s Office and the San Jose Police Department’s Homicide Unit are conducting a joint criminal investigation.  The case is being monitored by the San Jose Police Department’s Internal Affairs Unit, the City Attorney’s Office, and the Office of the Independent Police Auditor.
