SJPD Arrested Suspect for Possession of Child Pornography and Other Felony Crimes

TYPE OF CRIME: Possession of Child Pornography, Using a Minor to Pose for Child Pornography, Communication with Minor to Commit a Lewd Act, and   CASE NUMBER: 18-015-0304

Suspect Nathan Smith
San Jose, Calif. - The San Jose Police Department's Internet Crimes Against Children (ICAC) / Child Exploitation Detail (CED)  Task Force arrested Nathan Smith for Possession of Child Pornography with a previous conviction (felony) - 311.11(b) PC, Communicating with a minor to commit a lewd act (felony) - 288.3(a) PC, Directing a minor to pose for child pornography (felony) - 311.4(c) PC, and  Possession of child pornography involving sadism and masochism (felony) - 311.11(c) PC 

On January 2, 2018, ICAC detectives received a CyberTip from the National Center for Missing and Exploited Children (NCMEC) in regards to a subject using Yahoo Messenger to trade/distribute sexually explicit images involving children.  Some of the images involved children under the age of five.     

Follow-up investigation by ICAC detectives led to the identification of Nathan Smith as being the subject who was involved in trading/distributing child pornography using Yahoo Messenger.  Additional follow-up revealed that Smith was a lifetime registered sex offender for another child pornography case in 2010.

On January 18, 2018, ICAC / CED detectives along with the Santa Clara County Sheriff's Office S.A.F.E Task Force, and San Jose Division of the Federal Bureau of Investigation served a search warrant at Smith's residence in San Jose.  Suspect Smith was arrested without incident and booked into Santa Clara County Jail for the noted violations.
