San Jose, Calif.  The San Jose Police Department is investigating an officer involved shooting that occurred yesterday, October 31, 2019. This is an update to information previously provided.

On Thursday, October 31, 2019, at about 2:26 PM, San Jose police officers responded to a report of a man with a gun in the 2300 block of McKee Road in San Jose. Multiple witnesses reported seeing a man holding a handgun in the area.

Arriving officers saw the male suspect on the east sidewalk of North Jackson Avenue at McKee Road. The suspect was holding a gun in his hand.  Officers gave the suspect verbal commands to stop and drop the gun. The suspect refused to obey commands and placed the gun in his waistband. The suspect then walked across Jackson Avenue and northbound along the west sidewalk toward Independence High School. The suspect appeared to be drawing his gun when one officer fired at the suspect, striking him at least once. The suspect was taken to a local hospital where he was pronounced deceased a short time later. Officers recovered a replica handgun on the ground next to the suspect.


The identity of the suspect will be released by the Santa Clara County Coroner’s Office after they confirm the suspect’s identity and notify next of kin.

The officer was placed on routine paid administrative leave.  The Santa Clara County District Attorney’s Office and the San Jose Police Department’s Homicide Unit are conducting a joint criminal investigation.  The case is being monitored by the San Jose Police Department’s Internal Affairs Unit, the City Attorney’s Office, and the Office of the Independent Police Auditor.

Chief Eddie Garcia will provide a statement to the media on Tuesday, November 5, 2019. The media briefing will take place at the San Jose Police Department, 201 W. Mission St. in San Jose (Room 314).
