SJPD Arrests Suspect for 12-25-19 Homicide: 1200 block E. Santa Clara St., San Jose

San Jose, Calif. - On Wednesday, December 25, 2019, at about 2:16 AM, San Jose police officers responded to a silent burglar alarm in the 1200 block of E. Santa Clara St. in San Jose. Arriving officers were flagged down about a man lying on the street who appeared to have been struck by a vehicle. Officers located an unconscious adult male and a loaded firearm near him. The male was taken to a local hospital where he was pronounced deceased a short time later.

Follow-up investigation by homicide detectives revealed the following sequence of events that occurred in the same general area: The deceased male got in an argument with an adult male. The deceased male shot the adult male with a handgun and fled the scene on foot. A relative of the shooting victim, who was at the scene in a different vehicle, drove the male shooting victim to a local hospital.

A lone female driver, later identified as suspect Sabrina Marie Gutierrez, drove her vehicle onto the sidewalk and struck the male shooting suspect as he ran away. Suspect Gutierrez is also a relative of the male shooting victim. Suspect Gutierrez fled the scene in her vehicle. 

At about 2:21 AM, officers responded to a local hospital on a call of a shooting victim that was dropped off. Officers determined this was the same victim that had been shot at the above location. The adult male victim suffered non-life threatening gunshot wounds.

Detectives arrested suspect Gutierrez last night (12-25-19) in San Jose and booked her into Santa Clara County Jail for murder.

The identity of the victim will be released by the Santa Clara County Coroner’s Office after they confirm the victim’s identity and notify next of kin.

This is the City’s 34th homicide of 2019.
