What Is a Graduated Driver’s License?
(Formerly known as a Provisional License)
The graduated driver licensing program benefits new teen drivers by limiting their exposure to dangerous driving situations. Teens begin driving with mandated restrictions, which are gradually relaxed as drivers mature and develop greater driving skills.
California Vehicle code 12814.6 outlines three stages in a graduated license;
Stage 1: Learners Permit
- Must be at least 15.5 years old
- Must pass a vision and written test
- Must drive with a licensed driver age 25 or older
- Must have completed a driver education course
- Must undertake 50 hours of driving practice, including 10 at night
- Permit must be held for at least six months
- Must maintain a clean driving record
Stage 2: Provisional License
- Must be at least 16 years old, and under 18 years old
- Must complete behind-the-wheel training and pass an on-road test
- May drive without an adult present
- Not allowed to carry passengers under age 20 for first 12 months, unless a licensed driver age 25 or older is present (With exceptions for  certain school, work, medical and/or family reasons - a signed statement from a parent and/or guardian containing the probable date for driving, and reason to be carrying a passenger is required to be in the drivers possession)
- Driving not allowed between 11:00 pm and 5:00 am for the first 12 months, unless a licensed driver age 25 or older is present
- Must be held for at least 12 months, or until age 18
- Must maintain a clean driving record
Stage 3: Full License
- Must be at least age 18
- Must not have any outstanding DMV or court-ordered restrictions
- May drive without restrictions
