On June 7, 2024, at approximately 10:02 PM, San José Police Department Patrol Officers responded to a report of an assault with a deadly weapon at a restaurant located in the 5500 block of Cottle Road. Upon arrival, Officers discovered that multiple male suspects began an altercation with one adult male victim who was eating at the restaurant with his wife and infant child. During the altercation, one of the suspects produced a firearm and discharged a single shot towards the adult male and his family, where other unrelated bystanders were standing. None of the victims were struck by gunfire. All the suspects fled the scene prior to police arrival.
San José Police Department Gang Investigations Unit (GIU) Detectives immediately conducted a thorough investigation with the assistance of the Santa Clara County District Attorney's Office, and discovered the incident to be gang-related. Four suspects were identified as David Salas, Johnathan Hernandez, Brian Felix Rojas, and a juvenile male.
GIU Detectives obtained arrest warrants for all four suspects and search warrants for their respective residences. SJPD's Covert Response Unit (CRU), Violent Crime Enforcement Team (VCET), and Metro Unit assisted GIU Detectives with the warrant service. During the execution of the search warrants, two firearms with high capacity magazines and various clothing with gang indicia were seized from one of the residences.

Suspects Salas and Hernandez were booked into Santa Clara County Main Jail for gang-related assault with a deadly weapon and child endangerment. The juvenile suspect was booked into Santa Clara County Juvenile Hall for assault with a deadly weapon.
On August 13, 2024, suspect Rojas self-surrendered after being outstanding with a warrant for his arrest. Suspect Rojas was booked into Santa Clara County Main Jail for gang-related assault with a deadly weapon.
