On December 17, 2025, at approximately 2:22 PM, San José Police Department Patrol Officers responded to Peter's Bakery in the 3100 block of Alum Rock Avenue for a report of a vandalism and battery. The adult male suspect was attempting to sell products to the business and when the employee declined, the suspect became enraged, proceeding to damage items inside the business. An adult female victim, who was a store patron, was subsequently assaulted by the suspect after attempting to record the incident. The victim suffered minor injuries and was treated on scene by medical personnel. The unidentified suspect fled the scene prior to police arrival.
SJPD Assaults Unit Detectives began a thorough investigation and identified 44-year-old Eugene Morgan as the suspect. Detectives obtained a warrant for Suspect Morgan's arrest.
On March 3, 2026, Suspect Morgan was contacted in the state of Arkansas by Fort Smith Arkansas Sheriff's Deputies after they responded to a trespassing call for service. Suspect Morgan was subsequently arrested for both the trespassing as well as his outstanding warrant for the December 17th assault.
On April 9, 2026, the Santa Clara County Sheriff's Office extradited Suspect Morgan back to the state of California where he was booked into Santa Clara County Main Jail for felony vandalism and felony intimidation of a witness with violence. The Santa Clara County District Attorney's Office later filed charges for the same crimes.
"Our San José Police Department has proven once again that no matter where you flee, we will find you and hold you accountable for crimes you commit in our city," stated San José Police Chief Paul Joseph. "Hiding in Arkansas won't hide the fact you terrorized a resident, a local business, and a community as a whole. You have now returned to face the consequences."
“When someone attacks a local business and a resident, they don’t get to hide. Our officers and detectives identified the suspect, secured a warrant, and worked with law enforcement partners in Arkansas and the Santa Clara County Sheriff's Office to bring him back to California,” said San José Mayor Matt Mahan. “We will hold him accountable for the harm he caused, and we will keep protecting the people and small businesses that make San José run.”
