On July 26, 2026, at approximately 2:55 AM, San José Police Department Patrol Officers responded to a report of a shooting in the area of 7th Street and Leo Avenue. When Officers arrived, they located two adult males suffering from at least one gunshot wound each. Despite life saving measures, one victim succumbed to his injuries and was pronounced deceased at the scene. The second adult male was transported to a local hospital in critical condition and was later stabilized.

Simultaneously, Officers observed a vehicle traveling at a high rate of speed in the area of 11th Street and Humboldt Street. Officers conducted a vehicle enforcement stop and discovered a third adult male suffering from at least one gunshot wound inside the vehicle. He was transported to a local hospital for treatment and his injuries were later determined to be non-life threatening.

During the course of the investigation, Detectives utilized Automated License Plate Reader (ALPR) data to identify Jose Rivera and Laura Beltran-Gaitan as primary suspects. 

On July 31, 2026, with the assistance of the Covert Response Unit, Detectives located and apprehended Suspect Rivera and Suspect Beltran-Gaitan in the city of San José. Suspect Rivera was booked into the Santa Clara County Main Jail for murder. Suspect Beltran-Gaitan was booked into the Santa Clara County Main Jail for accessory after the fact. 

The motive and circumstances surrounding the event are still under investigation.

This incident is being investigated as the City's 16th homicide of 2026.
