Homicide Investigation: January 15, 2016, Delmas Avenue/Santa Clara Street

After follow up investigation it was determined this incident was a homicide and the case was turned over to the Homicide Unit.  The investigation lead to the identity of the suspect later identified as 79 year old Ernest Cervantes (booking photo above).  Suspect Cervantes was taken into custody on January 21, 2016 in San Jose and booked into the Santa Clara County Jail.  The suspect vehicle was also located and recovered. 

It was also determined that the suspect and the victim were known to each other. 

No other information is available at this time.


San Jose:  On Friday, January 15, 2016 at approximately 4:51 A.M., officers responded to the area of Delmas Avenue and Santa Clara Street on a report of a pedestrian who was struck by a vehicle.  Upon arrival officers located an adult male on the ground suffering from serious injuries.  Medical personnel arrived on scene and pronounced the pedestrian deceased at the scene a short time later.

Preliminary information is that a full size white pick-up truck was traveling southbound on Delmas Avenue and struck the pedestrian.  The driver (suspect) of the white truck continued southbound on Delmas, did not stop or to the scene.  San Jose Police Traffic Investigation Unit responded to the scene and took over the investigation.  The identity of the victim is not being released until the Coroner’s Office has confirmed the identity and next of kin have been notified.
