Update #3 (3/21/16)

On Friday, March 18, 2016 the adult male stabbing victim, Richard Shane Fernandez, was pronounced deceased at a local area hospital as a result of the injuries he sustained during the incident.

This is the city's 10th homicide of 2016.

Update 3-8-16

Follow-up investigation determined the stabbing was the result of domestic violence. The officer arriving on scene observed the female stabbing victim and was immediately directed to the suspect. The officer observed the suspect armed with a knife and immediately gave him several commands to drop the knife. The suspect was acting extremely agitated and did not comply with the officer's commands. Based on the aggressive behavior of the suspect, the officer feared for his safety and the safety of others in the immediate area. The officer fired at the suspect, striking him at least once.

Both stabbing victims are expected to survive. One of the victims remains hospitalized.



San Jose, Calif. - On Monday, March 7, 2016, at 6:15 p.m., San Jose Police officers responded to the area of S. 3rd St. and Martha St. on a report of a person stabbed. An officer in the area arrived shortly after being dispatched. The officer encountered several witnesses, the suspect, and two stabbing victims in front of a residence. The suspect was armed with a knife and the officer fired his duty weapon at the suspect. The suspect was shot and pronounced deceased at the scene. The suspect's name is withheld until next of kin is notified.

Both victims were transported to a local hospital. The female victim is in stable condition and the male victim is in critical condition, but expected to survive.

The officer will be placed on routine paid administrative leave. The San Jose Police Department's Homicide Unit is conducting the criminal investigation. The case is being monitored by the San Jose Police Department's Internal Affairs Unit, the Office of the Independent Police Auditor for the City of San Jose, and the Santa Clara County District Attorney's Office.
